1. Purpose and Scope
This Acceptable Use Policy ("AUP") defines the rules and guidelines for using the Phleekz platform (the "Platform"), operated by Walson Global Inc., a corporation incorporated in Ontario, Canada. This AUP applies to all users of the Platform, including but not limited to viewers, creators, subscribers, and any person or entity that accesses or interacts with the Platform in any manner.
This AUP supplements and is incorporated by reference into our Terms of Service. By accessing or using the Platform, you agree to comply with this AUP. If you do not agree with any part of this AUP, you must not use the Platform.
The purpose of this AUP is to protect the integrity, security, and availability of the Platform, safeguard our users and their data, and ensure a fair and respectful environment for all participants. Violations of this AUP may result in enforcement actions as described in Section 8.
2. Permitted Use
You may use the Platform only for lawful purposes and in accordance with this AUP, our Terms of Service, and our Community Guidelines. Permitted uses include:
- Browsing, viewing, and discovering content published on the Platform.
- Creating and uploading original content that you own or have the legal right to distribute, in compliance with our Community Guidelines and content policies.
- Interacting with other users through comments, messages, subscriptions, tips, and other features provided by the Platform.
- Managing your account settings, profile, and preferences.
- Using the Platform's monetisation features as a creator, in accordance with the Creator Agreement.
- Accessing the Platform via supported web browsers, mobile applications, or approved API integrations.
All use of the Platform must comply with applicable local, provincial, national, and international laws and regulations, including but not limited to Canadian federal and Ontario provincial law.
3. Prohibited Technical Activities
You must not engage in any of the following technical activities, whether directly or through third-party tools, services, or agents:
3.1 Reverse Engineering and Decompilation
- Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code, algorithms, data structures, or underlying ideas of the Platform or any of its components.
- Attempting to reconstruct, identify, or discover any proprietary technology, trade secrets, or confidential information used by the Platform.
- Circumventing, bypassing, or disabling any technical protection measures, access controls, digital rights management (DRM), encryption, or authentication mechanisms used by the Platform.
3.2 Scraping and Data Harvesting
- Using automated tools, bots, scrapers, crawlers, spiders, or similar technologies to access, collect, index, harvest, mine, or download content, data, or information from the Platform.
- Systematically downloading, storing, or redistributing content from the Platform, including but not limited to user profiles, images, videos, metadata, or user-generated text.
- Building or contributing to databases, datasets, or archives using content obtained from the Platform without express written permission from Walson Global Inc.
3.3 Denial-of-Service and Network Attacks
- Launching or participating in distributed denial-of-service (DDoS) attacks, denial-of-service (DoS) attacks, or any other action intended to disrupt, degrade, or overwhelm the Platform's infrastructure, servers, networks, or services.
- Flooding the Platform with requests, traffic, or data intended to consume excessive resources or impair service availability.
- Engaging in packet sniffing, traffic interception, or man-in-the-middle attacks against the Platform or its users.
3.4 Exploiting Vulnerabilities
- Probing, scanning, or testing the Platform for security vulnerabilities without prior written authorisation from Walson Global Inc.
- Exploiting any bug, vulnerability, or error in the Platform's software, infrastructure, or services, whether known or unknown.
- Injecting malicious code, including but not limited to viruses, worms, trojans, ransomware, spyware, adware, keyloggers, SQL injection, cross-site scripting (XSS), or any other harmful software or scripts.
- Attempting to gain unauthorised access to any account, system, network, server, or database associated with the Platform.
4. API and Automation Restrictions
If we provide API access or developer tools, the following restrictions apply:
- You must use our APIs only as documented and in accordance with any applicable API terms, rate limits, and usage quotas.
- You must not exceed posted rate limits or attempt to circumvent rate-limiting mechanisms through techniques such as key rotation, IP rotation, request distribution, or account cycling.
- You must not use our APIs to build competing products or services, replicate core Platform functionality, or create derivative works that substitute for the Platform.
- API credentials (keys, tokens, secrets) are confidential and must not be shared, published, or embedded in client-side code.
- Automated interactions with the Platform (including bots and scripts) must clearly identify themselves as automated and must not impersonate human users.
- We reserve the right to revoke API access at any time, with or without notice, if we determine that your usage violates this AUP or poses a risk to the Platform.
Any use of automation tools (including browser extensions, bots, or macro software) that interacts with the Platform in a way not explicitly supported by our official APIs or features is prohibited.
5. Network Abuse
You must not use the Platform or its services to engage in or facilitate any form of network abuse, including but not limited to:
- Sending or distributing unsolicited bulk messages (spam), whether through comments, direct messages, or any other communication feature of the Platform.
- Using the Platform to host, distribute, or link to malware, phishing pages, or other malicious content.
- Using the Platform as a proxy, relay, or tunnel for traffic not intended for the Platform's services.
- Manipulating network protocols, headers, or metadata to disguise the origin or nature of traffic to or from the Platform.
- Engaging in IP spoofing or forging TCP/IP packet headers in connection with the Platform.
- Using the Platform to conduct port scanning, network reconnaissance, or vulnerability scanning against any third-party systems.
- Interfering with the proper functioning of the Platform for other users, including degrading performance, causing instability, or disrupting service delivery.
6. Account Misuse
You are responsible for all activity that occurs under your account. The following account-related activities are prohibited:
- Creating multiple accounts for the purpose of evading enforcement actions, circumventing restrictions, or manipulating Platform features (such as voting, ratings, referral programmes, or promotional offers).
- Sharing, selling, transferring, or trading accounts or account credentials with others, unless explicitly permitted by the Platform.
- Using stolen, fraudulent, or falsified identity information to create or maintain an account.
- Impersonating another person, entity, or brand through your account name, profile, or content, with the intent to deceive or mislead.
- Accessing or attempting to access another user's account without authorisation.
- Using your account to facilitate fraud, money laundering, or any other financial crime.
- Artificially inflating engagement metrics (views, likes, follows, subscribers) through automated means, purchased engagement, or coordinated inauthentic behaviour.
- Using the Platform to collect, harvest, or compile information about other users, including email addresses or personal information, without their consent.
You must keep your account credentials secure and notify us immediately at support@phleekz.com if you suspect any unauthorised access to your account.
7. Intellectual Property and Content Restrictions
In addition to the content rules set out in our Community Guidelines, the following restrictions apply to your use of content on the Platform:
- You must not upload, share, or distribute content that infringes the intellectual property rights (copyright, trademark, patent, trade secret, or other proprietary rights) of any third party.
- You must not reproduce, redistribute, publicly display, publicly perform, or create derivative works from content obtained from the Platform without the express permission of the content owner.
- You must not frame, mirror, or embed the Platform or its content on another website or application without our written consent.
- You must not remove, alter, or obscure any copyright notices, watermarks, trademarks, or other proprietary notices from content on the Platform.
- You must not use the Phleekz name, logo, or branding in any way that suggests an endorsement, partnership, or affiliation without our prior written approval.
8. Enforcement and Consequences
We reserve the right to investigate and take appropriate action against any user who, in our sole discretion, violates this AUP. Enforcement actions may include, without limitation:
8.1 Graduated Enforcement
- Warning: A formal notice identifying the violation and requesting corrective action.
- Content removal: Removal of specific content that violates this AUP.
- Feature restriction: Temporary or permanent restriction of access to specific features (e.g., uploading, commenting, messaging, monetisation).
- Account suspension: Temporary suspension of your account for a defined period.
- Account termination: Permanent termination of your account and revocation of access to the Platform.
8.2 Immediate Action
We may take immediate action, including account suspension or termination without prior warning, in cases involving:
- Security threats or active exploitation of vulnerabilities.
- DDoS attacks or other network abuse.
- Distribution of malware or malicious content.
- Activities that pose an imminent risk to the safety of users or the integrity of the Platform.
- Violations of applicable law.
8.3 Legal Action
We reserve the right to pursue any and all legal remedies available to us, including civil litigation and referral to law enforcement authorities, in connection with violations of this AUP. Walson Global Inc. will cooperate with law enforcement investigations as required by applicable law.
9. Reporting Violations
If you become aware of any activity that violates this AUP, we encourage you to report it promptly. You can report violations through the following channels:
- In-platform reporting: Use the "Report" feature available on content, profiles, and messages throughout the Platform.
- Email: Send a detailed report to support@phleekz.com with the subject line "AUP Violation Report."
When reporting a violation, please provide as much detail as possible, including:
- A description of the violation and the specific section of this AUP you believe was violated.
- The URL, username, or other identifying information related to the violating activity.
- Screenshots, logs, or other evidence supporting your report.
- Your contact information so that we may follow up if needed.
All reports are reviewed by our Trust and Safety team. We may not be able to disclose the outcome of our investigation due to privacy and legal considerations, but we take all reports seriously and act on them in accordance with this AUP and applicable law.
10. Relationship to Terms of Service and Community Guidelines
This AUP is part of the legal framework governing your use of the Platform. It should be read in conjunction with:
- Terms of Service: The overarching agreement governing your use of the Platform, including provisions on liability, dispute resolution, intellectual property, and account termination.
- Community Guidelines: Detailed rules governing the types of content permitted on the Platform, standards of behaviour, and content moderation practices.
- Privacy Policy: Our practices for collecting, using, and protecting your personal information.
- Cookie Policy: Our use of cookies and similar tracking technologies.
- Creator Agreement: Additional terms applicable to users who create and monetise content on the Platform.
In the event of a conflict between this AUP and the Terms of Service, the Terms of Service shall prevail unless this AUP explicitly states otherwise. This AUP provides additional specificity on technical and behavioural requirements that complement the broader Terms of Service.
We may update this AUP from time to time. Material changes will be communicated through Platform notifications or email. Continued use of the Platform after changes are posted constitutes acceptance of the updated AUP.
